WEB DESIGN COPYRIGHTS the untold debate

Recommended Posts

ok i would believe this would be the biggest topic of all time where does the copyrights for any scripting excluding software start and were does it end.its amazing how people can say their html is copyrighted when a few million designers use the same thing, pictures understandale but not html, cgi, javascript, php, asp and all those other scripting related things.yeah starting webdesign i took some ideas or plane out copyed the whole page just to get a understanding of it but still.. oh i could swing it the whole other way and say i might be wrong and its www protocal which i highly doubt that.for all te javascripts that i see or used thiers alot of copyrighting going on and where credit due yeah some maybe orginal or simple to do but still when some crazy webdesigner is finding his layout all over the net saying they will press changes or some *BLEEP* like that can blow it out my *bottom*.so i SAY SCREW WWW COPYRIGHTING IN ALL ITS FORMS

I have done some researching on this and depending on the layout of your sight you can actually put the Copyright symbol on the page if it is truly unique design for intellectual rights. And win a copyright case in the US court system with it. So things like your logo's are more like trademarks then copyrights in all honestly but intellectual rights can be copyrighted and if used entitle you to money.

In the UK, everything is automatically copyrighted, however, you cant easily prove that you are the owner of something - Which is really the big problem in web! With scripts, style sheets, and HTML, you cant really say you are the original owner, because, chance is, several other people have all written the same script in the same way, and there is no way of proving who did it first, also, it is so eay to take them, as they are available to the browser, and thus, available to anyone who accesses the site! However, server side is another story, you have you have to gain access to a sites files to see its PHP source code. Although, the who made it first problem still exists, however, with larger websites, with huge PHP files, it would be hard for someone who had taken the source code to say that it was just by chance, that their code was exactly the same!I think all clientside code should be free to use, with no ownership, as there ois relatively no way to prove who did something first, and then you cant stop people using it, the internet is too big! - also, you'd end up with people claiming to be the first people to make an alert with a button or something stupid! But clientside, given that it is used in huge web applications, and cannot be easily accessed by anyone who doesnt have the relevant passwords, should have a good system for protecting the copyright of the code...

Html itself can't be copyrighted, it's almost like copyright the English language or something. Sure we say the same things every now and then but we can't copyright it because everyone does.Website designs, layouts and graphics should be copyrighted but not the scripts.

I believe that if a design is written in any script more complicated than html and css it should be copyrighted... I also believe it should be the responsibility of the creator to take the necessary steps to copyright it.. for someone to spend all their time learning and creating a code and then not take the steps to lay claim to me, is paramount to having invented a pencil and then leaving all your newly crafted pencils in boxes in the middle of a mall for ppl to take... Would you go up to ppl using pencils later and say, dood you didnt pay for that?... proving coding is as simple as printing out a copy and mailing it to yourself.. Bam USPS dated stamp proof of creation date...

okay boys and girls you left out one important thing of all this copy written stuff. Its not the html css php or even the grapics but the text that is copy written. A logo as well as any GX would come under a trademark. but if you will look at most every site on the net other than the text and maybe some graphics or java scripts they are all the same. same, you can not copy something that is public domain such as HTML PHP some Java Scripts due to they are published in too many how too books and even here in Xisto of that matter. If that is the case then even this posting using php should be copy written.

I would love to see copyrights on designs, but it is very hard to copyright common coding. However, it is all how you put the code together that makes it unique. For example, words are not copywritten, however when you compile a combination of those words together to form a sentance or a paragraph, then you can copyright that if it has not been before. It is all about originality. I would think that us designers need to be protected in a sense so that we do not get discouraged when people keep stealing our work.
